The Converse/Dazed 2013 competition is now open. We are looking for emerging visual artists with guts, drive, determination and most importantly, imagination.

The Converse/Dazed 2013 competition is now open. We are looking for emerging visual artists with guts, drive, determination and most importantly, imagination. There are no constraints on medium or intention – all we want is to give you a chance to win £5,000 and exhibit your work to tastemakers and art-world figures at a space in the heart of east London.

TERMS & CONDITIONS

THE COMPETITION

These terms and conditions govern the participation of individuals who submit entries (the “Entrants”) in the Converse/Dazed 2013 Emerging Artists Award (the “Competition”).

By submitting an entry to in respect of the Competition, you agree to comply with and be bound by these terms and conditions.

The Promoters reserve the right to exclude any Entrant and/or withdraw any prize where the Promoters deem, in their sole opinion, that the Entrant has not complied with these terms and conditions.

THE PROMOTERS

The Competition is promoted jointly by Converse Europe Limited, a company incorporated and registered in England and Wales with company number 7133557 whose office is at 100 New Bridge Street, London EC4V 6JA and Waddell Limited (trading as Dazed & Confused) a company incorporated and registered in England and Wales whose registered office is at 112-116 Old Street, London, EC1V 9BG, United Kingdom (the “Promoters”).

CONDITIONS OF ENTRY

All Entrants must be under 35 years old. All Entrants under the age of 18 must have gained the permission of their parent or guardian before entering the Competition and must be accompanied by their parent or guardian at the Competition’s associated activities or events including the Prize Event.

All Entrants must be British or resident in the UK.

Entrants submitting work cannot be represented by a UK gallery.

Entrants must not currently be studying at University or art school.

Entrants may submit a maximum of five files including their CV and a one-page statement setting out the Entrant’s explanation of and inspiration behind the entry(images being of a minimum of 1,000 pixels long on the shortest side). If submitting video or sound pieces, excerpts must be no longer than three minutes in length. Files submitted via this page must not exceed 25mb in size. A maximum of 5 files may be uploaded. Entries which exceed this limit shall not be considered.

All entries must be submitted via this page. As further described under paragraph 36 below, the Promoter shall not be liable for any lost, undeliverable, late, misdirected or illegible entries.

An entry must not have been previously published and the Entrant may not submit the entry in any competition, talent show or similar event prior to 6th May 2013. Competition Winners and Shortlisted Entrants (as defined below) shall not submit their entry in any competition, talent show or similar event conducted by any third party and shall not permit any third party to publish advertise or promote their entry other than with the prior written consent of the Promoters.

The closing date for entries to the Competition is the 25th June(the “Closing Date”). Entries which are submitted after the Closing Date will not be considered.

Entrants who are shortlisted will be required to hand in their portfolio and further examples of their work by July 15th 2013. Failure by the Entrant to submit their portfolio and further examples by this date may result in disqualification from the Competition. Entrants agree to allow the Competition judges to both retain and review the Entrant’s portfolio until the selection process is complete.

All Entrants warrant that the information submitted in their online entry form (and any other information supplied to the Promoters or any other third party in relation to the Competition) is true and accurate.

No purchase is required or accepted as a condition of participating in the Competition. Participation in the Competition is free. The Entrant confirms that they will not publish or post to any website or other media operated by Promoters or related to the Competition any text, statement, photograph, image or other material which is obscene, defamatory, infringes the intellectual property or other legal rights of any third party or is otherwise unlawful, offensive or inappropriate. The Promoters will have the right to remove any material at its discretion and take appropriate legal action against any person found to be or alleged to be in breach of this paragraph.

The following persons are not eligible to enter the Competition: i) employees of any business involved or associated with the Competition (including the Promoters and its associated companies); and ii) any such person’s family or household members. The Promoters reserve the right to verify the eligibility of all Entrants.

THE JUDGING CRITERIA

The judges shall select from all entries submitted to the Competition the Shortlisted Entrants and the Competition Winners (as defined below) based on what they feel to be the best, most innovative, interesting, well produced and strongest work.

In selecting the Shortlisted Entrants and Competition Winners, the judges’ decision is final and no correspondence will be entered into other than with the Competition Winners.

SHORTLISTED ENTRANTS

During each week of the Competition the Promoters may publish on its website (or in such other manner as the Promoters may decide) shortlisted entries which will be considered for the Prize (the “Shortlisted Entrants”). By submitting an entry the Entrant agrees for their entry to shown in such a manner and to partake in interviewing and supplying further imagery and information as required by the Promoters.

Shortlisted Entrants chosen for the exhibition Prize Event (as described under paragraph 24) will be expected to travel to London for the gallery exhibition and to take part in reasonable promotional publicity. Each Shortlisted Entrant will be responsible for their own travel expenses and insurance.

THE PRIZE

The winning Entrant will be awarded £6,000 and the five runners up will receive £1,000 each (together the “Competition Winners”).

Competition Winners under the age of 18 may be required to provide a written acknowledgement of all terms and conditions of the competition signed by their parent or guardian before receiving their prize.

Competition Winners will all have their work (which may include their entry along with other work form their portfolio) shown in a group show in London during 2013 along with selected Shortlisted Entrants (the “Prize Event”). The Competition Winners agree to attend the Prize Event and to cooperate with the production and the curating of the exhibition as the Promoters shall reasonably require.

It is anticipated that the Prize Event will be held at the Stephen Friedman Gallery (the “Gallery”). However, the Promoters reserve the right to change the location of the Prize Event without notice. Any Entrant whose entry is chosen to be displayed at the Prize Event shall provide the Promoters with an installation specification of the entry (if applicable), including all technical equipment required, and shall cooperate with the Gallery regarding the collection, transportation and installation of their entry on the dates specified by the Gallery. The Entrant shall at all times comply with the health and safety policies of the Gallery.

The Competition Winners agree to be interviewed, photographed and to supply imagery for use in a Dazed & Confused feature article surrounding the project and other such promotional material as the Promoters shall reasonably require.

The prize may not be substituted for any alternative prize and may not be transferred to any other person. The Promoters reserve the right to offer an alternative prize of equal or greater value.

No expenses or travel costs incurred by any Entrant (or if the Entrant is under 18 their parent or guardian) in connection with the Competition or the Prize and/or the Prize Event will be paid by the Promoters.

NOTIFICATION OF WINNERS

The Competition Winners will be notified on or before 5th July

OWNERSHIP OF ENTRIES

All Entrants will retain ownership in all intellectual property rights which subsist in their entry.

The Entrant hereby irrevocably grants to the Promoters and any of the Promoters’ group companies (which includes any company owned, controlled or associated with the Promoters), until 1/11/2013, a worldwide royalty free licence to reproduce in any format or medium the entry (or any depiction of the entry) for such promotional and/or commercial activities as the Promoters require (including on-line promotion) and to reproduce the entry on DazedDigital.com and within Dazed & Confused magazine. The Promoters shall be permitted to develop, modify and adapt any entry submitted by the Entrant to the Competition for the purpose of reproducing the entry as described herein. The licence granted under this paragraph 31 shall further extend to the right to reproduce in any format or medium the Entrant’s portfolio work (or any depiction of the Entrant’s portfolio work) solely for the purpose of promoting and/or advertising the Prize Event.

By entering the Competition, all Entrants agree to allow the free use of their names, and entries for publicity and news purposes during this and future promotions by the Promoters or any associated or subsidiary company of the Promoters.

By submitting an entry, the Entrant hereby warrants and declares that their entry is their own original and produced by them and that the intellectual property (including copyright) of any third party would not be infringed by the Promoters’ use of the entry (whatever use that may be) and that the entry is not subject to any claim of ownership by any third party. Entries that are found to contain work created by anyone other than the Entrant will be deemed ineligible for the competition.

The Entrant will indemnify the Promoters and the Gallery against any claim that an entry infringes the intellectual property rights of a third party.

The Entrant shall provide its full cooperation to the Promoters or the Gallery in the event of any claim being made by a third party against the Promoters that the entry infringes the intellectual property rights of a third party.

LIABILITY

Except for death or personal injury arising as a result of the Promoters’ negligence, the Promoters hereby excludes any and all liability arising under or in connection with the Competition including, without limitation, any liability for:

– any lost, undeliverable, late, misdirected or illegible entries;

– any error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction of an entry or any information submitted to the Promoters;

– technical, network, electronic, computer, hardware of software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by the Promoters on account of technical problems or traffic congestion on the internet and/or any relevant website;

– any injury or damage to any Entrant’s or any other person’s computer related to or resulting from participation in the Competition;

– any damage caused to a Competition Winner’s entry whilst such entry is in the possession of the Promoters.

VARIATION

The Promoters shall have the right to vary these terms and conditions by posting amended terms and conditions on its website DazedDigital.com at any time.

DATA PROTECTION

All information relating to Entrants collected by or on behalf of the Promoters from which each Entrant can be identified will be recorded electronically and will be used and processed at all times in accordance with the Data Protection Act 1998.

JURISDICTION

These terms and conditions and any dispute or claim arising out of or in connection with them or the Competition (including any non-contractual claims or disputes) shall be governed by and construed in accordance with the laws of England and Wales and the parties irrevocably submit to the exclusive jurisdiction of the English courts.
