Duncan and 14 other gang members were in court last week facing attempted murder charges relating to shooting incidents last year. Duncan has a clean criminal record and has not been linked to the shootings, but prosecutors want to snag him on a barely visible California law that states gang members can be sent to jail if they benefit from the illegal actions of their fellow gang members. The prosecution says that the shootings enhanced the fearsome reputation of the gangs and allowed Tiny Doo to sell more copies of No Safety, an album that has a revolver as its cover art. "We're not just talking about a CD of anything, of love songs," deputy district attorney Anthony Campagna said. "We're talking about a CD (cover)... there is a revolver with bullets." "It's shocking," Duncan's attorney Brian Watkins told ABC News. "He has no criminal record. Nothing in his lyrics say go out and commit a crime. Nothing in his lyrics reference these shootings, yet they are holding him liable for conspiracy. There are huge constitutional issues." This isn't the first time a rapper's work has found its way into the courtroom. Earlier this year, New York gang member and rapper Ronald "Ra Diggs" Herron was found guilty of three murders after his violent lyrics were used against him in court. Prosecutors successfully argued that Herron's boastful lyrics documented and glorified the crimes he was being accused of. A judge decided on Monday that Duncan will go to trial.
