TERMS AND CONDITIONS
These rules (“Competition Rules”) and any other rules specified by
Waddell Limited or any of its group of companies (the “Company”) from
time to time apply to any competition which is run on or through our
magazine titles including but not exclusive to Dazed & Confused,
Another Magazine or Another Man (the Titles) or through our associated
Websites operated by or on behalf of the Company. By taking part in a
Competition, you agree to be bound by the Competition Rules and by the
decisions of the Company, which are final in all matters relating to
the Competition. The Company reserves the right to disqualify any
entrant and/or winner in its absolute discretion for any reason and
without notice in accordance with the Competition rules.
Unless otherwise notified, no purchase is necessary to enter a
Competition. You may be offered the chance to subscribe for a
newsletter but failing to do this will not disqualify you from a
Competition. A third party sponsor of the Competition may provide
prizes. The Company reserves the right in its sole discretion to
substitute any prize with a prize of comparable value. All entries must
be received by the deadline for that Competition and late or incomplete
entries may, in the absolute discretion of the Company, be
disqualified. No responsibility can be accepted for entries which are
lost, delayed, misdirected or corrupted during delivery to or from the
Company due to any computer malfunction, virus, bug, delay or failure
of the postal service or other reason whatsoever.
By entering a Competition you grant the Company and any sponsor(s) of
the Competition (the “Competition Sponsor”) permission to:
a) use your name and likeness for the purpose of administering and organising the Competition
b) disclose your name and any other information you provide to the
Company to third parties appointed by the Company or the Competition
Sponsor for the purpose of administering and organising the
Competition.
By entering a Competition you:
a) Grant the Company
the right free of charge to feature your Competition entry in any
magazine published or any website operated by or on behalf of the
Company and all licensed editions of the same throughout the world
b) Irrevocably and unconditionally waive any moral rights or similar
rights you have in your Competition entry whether such rights arise
pursuant to the Copyright, Designs and Patent Act 1988 (the “Act”) or
equivalent legislation anywhere in the world, save that the Company
shall take all reasonable steps to ensure that you are credited as the
author of the Competition entry
c) Warrant to the Company that the Competition entry is wholly original
to you and not wholly or substantially copied from any other material
and that the Competition entry does not libel, defame, cause injury to,
offend or invade the privacy of or otherwise infringe or violate any
statutory, common law, regulatory or intellectual property rights of
any third party
d) Consent to the Company passing your name, address and likeness to
any third party appointed by the Company or any Competition Sponsor to
administer and organise the Competition, to deliver the prize or prizes
to you and/or to contact you for advertising and promotional services.
Rights granted by the entrant
The entrant grants to the Company a license to use the photographic
image(s), illustrations, or other work (referred to in this agreement
as “creative submissions” for publication by the Company in “the
Titles” and associated media, and the entrant retains ownership of the
copyright of the creative submissions.
The rights in creative submissions(s) hereby licensed consist(s) of:
a) Publication in the Titles and any licensed edition thereof
b) Use of creative submissions(s) in publicising, promoting and
advertising The Company, including any branded Internet presence of the
company or the Competition Sponsor.
Obligations on the Company
The entrant agrees not to licence any third party to use of publish
creative submissions(s) until 60 days have elapsed after the date of
publication of creative submissions(s) by the Company in whatever form
or media. In consideration of the grant of the licence by the entrant,
the Company may publish creative submissions(s) in the magazine
published by it. The entrant will receive accreditation for the
publication. Should the Company decide, in its sole discretion, not to
publish creative submissions(s), within nine months of the date of this
agreement, the entrant will be advised and creative submissions(s) will
be returned, at the request of the entrant. The Company has the sole
discretion to publish creative submissions(s) in any way, which it may
think fit, pursuant to the terms of this license.
Warranty by the entrant
The entrant warrants as follows:
a) The entrant is the sole originator and owner of creative
submissions(s) and all rights which the entrant grants to the Company.
b) Creative submissions(s) is/are original work(s).
c) Creative submissions(s) does/do not infringe any third party’s
statutory copyright or statutory trademark, common law rights,
propriety rights or any other rights of any nature.
d) Creative submissions(s) and all rights in it/them are in every respect free and clear of any claim or lien.
e) The entrant indemnifies the Company in respect of any claim, which is brought in breach of the above warranty.
Succession, variation, governing law
This agreement is legally binding upon the Entrant and the Company and
any successor in title of either. The agreement contains all of the
terms agreed and no waiver or modification of any term of the agreement
will be valid, unless it is in writing and signed by the Entrant and
the Company. This agreement is subject to English law.
Winner(s) will be notified as soon as reasonably practicable after the
Competition draw/decision. If you are a winner, you may have to provide
additional information and/or complete additional documents and return
them to the Company within a specified period. Failure to provide
additional information and/or complete additional documents within the
required time period, or notification returned as undeliverable as
addressed will result in your disqualification as a winner and an
alternative winner will be selected.
The receipt by you of any prize is conditional upon you complying with
any and all applicable laws, rules and regulations including, without
limitation, the Competition Rules. Unless otherwise stated in the prize
description, winners are solely responsible for all costs and expenses
associated with claiming the prize including, without limitation,
delivery costs.
The Company reserves the right to implement age requirements or other
eligibility criteria in its absolute discretion. Unless otherwise
stated, Competitions are not open to; (a) the employees, agents or
subcontractors of the Company; (b) any Competition sponsor or its
employees, agents or subcontractors; (c) the immediate families of such
employees or sponsors.
If you are a winner of a Competition you acknowledge and agree that the
Company, any Competition Sponsor and each of their employees, agents
and subcontractors shall have no liability whatsoever in connection
with the use or possession of any of the prizes awarded pursuant to
Competition, provided that nothing in these Competition Rules shall
exclude or limit the liability of any party for personal injury or
death caused by negligence or for anything else which cannot be
excluded or limited by law.
The Company may update these Competition Rules from time to time. If it
does so, the updated version will take effect from the date it is
uploaded on our associated Websites operated on behalf of the Company.
